ACB Services — 3D Printing Terms & Conditions
Important: This policy is provided for general information only and does not constitute legal advice. By placing an order with ACB Services (“we/us/our”), you (“you/your” or “Customer”) agree to these Terms. If anything here conflicts with a written contract signed by both parties, that contract controls.
1) Scope of Service
ACB Services provides on-demand 3D printing and related finishing services based on Customer-supplied files or designs selected from our catalog. We manufacture parts to the specifications, materials, and settings stated in your order confirmation.
2) Customer Responsibilities & Representations
- You confirm you have all necessary rights, licenses, and permissions to use, upload, and have us manufacture the submitted design(s).
- You grant us a non-exclusive, limited license to use your files solely to quote, manufacture, inspect, and ship your parts.
- You agree your design complies with all applicable laws and regulations (including export control).
3) Prohibited Content
We will not print or help produce:
- Weapons, weapon components, or regulated parts;
- Items intended for unlawful activity;
- Items that infringe third-party IP;
- Items that are unsafe by design, or primarily intended to cause harm;
- Medical devices, implants, life-support, load-bearing or safety-critical parts unless we expressly agree in a signed writing and proper certifications are provided.
We may reject any order at our discretion.
4) Materials, Tolerances & Finishes
- Unless otherwise stated, typical fused-filament tolerances: ±0.5 mm or ±1% (whichever is greater). Resin or other processes may vary; quoted tolerances apply.
- Surface finish, color, sheen, and texture can vary batch-to-batch. Minor cosmetic artifacts (layer lines, support marks, slight warp) are normal for additive manufacturing.
- No food safety or biocompatibility is implied. Materials are not certified food-safe, flame-rated, or medical-grade unless explicitly stated.
- You are responsible for fit/function testing, post-processing, and verifying suitability for your use.
5) Quotes, Pricing & Payment
Quotes are estimates based on your files, materials, and quantities at the time of quoting and may change if files or settings change. Orders must be paid in full before production unless we agree otherwise.
6) Order Changes & Cancellations
Orders move to production quickly. Changes or cancellations may not be possible once printing starts. If allowed, you may be responsible for material and time already used.
7) Shipping, Risk of Loss & Delivery
We ship to the address you provide. Title and risk of loss transfer to you upon carrier pickup. Delivery dates are estimates, not guarantees. Inspect packages upon receipt and notify us of visible damage within 48 hours.
8) Inspection, Reprints & Returns
- Report manufacturing defects within 7 days of delivery, with photos and order info.
- If we confirm a manufacturing defect (not design, handling, or shipping damage), we may, at our option, reprint or refund the affected items.
- Because parts are custom-made-to-order, all sales are otherwise final and non-returnable.
9) No Engineering or Compliance Services
Unless expressly agreed in writing, we do not provide engineering, design validation, or regulatory certification. You are solely responsible for ensuring that your part and its use comply with applicable standards, codes, and laws.
10) Safety & Intended Use
3D-printed parts may fail unexpectedly. Use them at your own risk. Do not use for life-critical, structural, or safety-related applications unless expressly agreed in writing and supported by appropriate testing and certifications.
11) Intellectual Property & Confidentiality
You retain IP rights in your designs. We will not disclose your files to third parties except as needed to fulfill your order (e.g., subcontracted finishing) and will take reasonable steps to protect your information. We may retain production data/files for quality, reprint, and recordkeeping purposes.
12) Warranty Disclaimer
EXCEPT AS EXPRESSLY STATED, ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO ANY ORDER SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR DOWNTIME.
14) Indemnification
You agree to defend, indemnify, and hold harmless ACB Services and its owners, employees, and contractors from any claims, damages, or costs (including attorneys’ fees) arising from your designs, instructions, misuse of parts, or violation of these Terms.
15) Export Compliance
You represent your design is not subject to ITAR/EAR restrictions or other export controls. If it is, you will notify us in writing in advance and we may decline the order.
16) Privacy
We collect only the information necessary to quote, produce, ship, and support your order. See our Privacy Notice for details on data retention and your rights. We do not sell personal data.
17) Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., supply disruptions, carrier delays, power/network outages, severe weather).
18) Governing Law & Disputes
These Terms are governed by the laws of [Your State/Province], without regard to conflicts principles. Venue and jurisdiction lie in the state and federal courts located in [Your County/State]. You agree to bring claims individually (no class actions).
19) Changes to Terms
We may update these Terms from time to time. The version posted at the time of your order applies to that order.
